1.What KeepYa is and who these terms apply to
KeepYa (keepya.app) is a platform that lets businesses create and run loyalty programs with digital cards for Apple Wallet and Google Wallet, rewards, coupons and communications.
These terms apply to:
- Customers: people who join the loyalty program of a business that uses KeepYa.
- Businesses: merchants who hire KeepYa to run their program. Specific commercial conditions (plans, limits and billing) are agreed when the service is contracted.
By joining a program or using the platform you accept these terms. If you disagree with them, do not use the service.
2.The loyalty program
Every loyalty program belongs to the business offering it. The business sets its rules: how points or stamps are earned, which rewards exist, what levels there are, when benefits expire, and at which locations you can take part.
KeepYa provides the technology to run the program, but is not a party to the commercial relationship between you and the business and does not guarantee the availability of the business's prizes, products or services.
3.Sign-up and digital card
- To take part you must provide accurate information and keep it up to date.
- Sign-up is personal: one registration per person per business. The business may limit participation to adults.
- When you sign up you receive a digital card for Apple Wallet or Google Wallet, which is how you identify yourself in store and collect benefits.
- You are responsible for looking after your digital card and the personal links you receive by email; do not share them.
4.Points, stamps, rewards and coupons
- Points, stamps, balances, rewards and coupons hold no monetary value, cannot be exchanged for cash, and are not transferable between people or between businesses.
- They are recorded in store by the business's staff (for example, by scanning your card) or through the mechanisms the business enables (such as delivery QR codes).
- Rewards and coupons are redeemed in store and may carry additional conditions set by the business (validity, stock, per-customer limits).
- The business may adjust, correct or cancel points and benefits obtained in error or through fraud.
- Coupons and rewards may have an expiry date; once expired, they can no longer be redeemed.
5.Communications
There are two kinds of messages:
- Operational messages: needed to provide the service (delivery of your digital card, confirmations and links you request). These are always sent.
- Program notifications: news, rewards, benefits and campaigns from the business, by email or push on your card. These are only sent if you gave your consent, and you can unsubscribe at any time from the "Manage my notifications" link in every email.

6.Acceptable use
When using KeepYa you agree not to:
- Create false or duplicate registrations, or use someone else's details without their permission.
- Manipulate the points, referral, reward or coupon system to obtain undue benefits.
- Interfere with the platform, attempt to access other users' data, or circumvent its security measures.
- Use the platform for illegal activity or to send unauthorised communications.
Breaching this may result in benefits being cancelled and the registration or account being closed.
7.Intellectual property
The KeepYa platform, its software, design and trademarks belong to KeepYa or its licensors. Each business's trademarks, logos and content belong to that business. Nothing in these terms grants you licences over them beyond normal use of the service.
8.Personal data
How your personal data is handled is described in the Privacy Policy. In short: the business is the controller of its program's data and KeepYa processes it on the business's behalf to run the service.
9.The business's responsibility
The business is responsible for:
- Setting and honouring its program's rules, and delivering the rewards and coupons it offers.
- The accuracy of its brand, content and the communications it sends through the platform.
- Using its customers' data in line with applicable law and obtaining the necessary consents when it adds data by its own means.
Any complaint about the program's products, services or prizes should be directed to the business.
10.Availability and service changes
We work to keep the platform continuously available, but interruptions may occur due to maintenance, updates or causes beyond our control. We may modify or discontinue features; if a change materially affects the program you belong to, the business or KeepYa will communicate it by a reasonable means.
11.Limitation of liability
To the fullest extent permitted by law, KeepYa is not liable for indirect damages or for the loss of promotional benefits (points, stamps, coupons or rewards), which hold no monetary value. Nothing in these terms limits rights that your country's consumer or data protection law grants you on a non-waivable basis.
12.Termination
- You may leave a program at any time by removing your digital card and asking the business, or hello@keepya.app, to delete your data.
- The business may end its program or its relationship with KeepYa; in that case, accrued benefits are governed by the business's rules and applicable law.
- KeepYa may suspend registrations or accounts that breach these terms.
13.Changes to these terms
We may update these terms. If a change is material, we will update the "last updated" date and communicate it by a reasonable means before it takes effect. Using the service after that date means you accept the terms then in force.
14.Governing law
These terms are governed by the law of the country where the business offers its program as regards your relationship with that business, and by Spanish law as regards your use of the KeepYa platform, without prejudice to the mandatory consumer protection rules that apply in your country of residence.
